Deprived of public representation while cop gets public DA

So if you are charged with criminal offenses and the arresting officer decides to take jail time off the table, you are not eligible for public representation. Yet he is still aided by a public DA, is this right? Should an arresting officer dictate whether their arrestee qualifies for public representation?

Apparently you were arrested for being severely retarded. They are not jailing you because they realize you should be in a different kind of facility, with your own personal helmet and windows you can lick.
