Is "Skimping" Illegal in Fairfax County?

I've noticed a lot of college kids do "skimpy" on social media.

For those that don't know, "Skimpy" is skinny dipping but you keep your bathing suit with you and never leave the water. Generally, there is a pic of the person holding their bathing suit over their naked body but you only see their head out of the water.

My question is, since nobody sees them naked are they breaking any laws? How could any one prove they are naked?

It's the difference of a ticket for exposure. If you are in the water you are covered. Correct?
