(CNN) -- A California school that stopped students from wearing American flag T-shirts on Cinco de Mayo didn't violate their constitutional rights, an appeals court ruled Thursday.

The school's approach, according to the appeals court, kept students safe in a climate of racial tension.

"The controversy and tension remained," a panel of judges from the 9th Circuit Court of Appeals said in their opinion, "but the school's actions presciently avoided an altercation."

School officials were worried about violence and disruption of school activities "and their response was tailored to the circumstance," the opinion said.

The case dates back to May 5, 2010, when the principal of Live Oak High School in Morgan Hill, California, asked a group of students wearing American flag T-shirts to turn their shirts inside out or take them off.

The students at the Northern California school refused, according to the appeals court's summary of the case, and later brought a civil rights suit against the school and two administrators, arguing that their rights to freedom of expression, equal protection and due process had been violated.

Judges said the civil rights case forced them to weigh the difficult question of what takes precedence: students' free speech rights or school safety concerns?

According to court documents, the incident occurred amid "ongoing racial tension and gang violence within the school, and after a near-violent altercation had erupted during the prior Cinco de Mayo over the display of an American flag."

The previous year, court documents said, a group of students carrying a Mexican flag had clashed with students who hung an American flag from a tree and chanted "USA" on Cinco de Mayo, a holiday marking a famous Mexican military battle that is often celebrated in the United States.

In 2010, the appeals court said, "threats issued in the aftermath of the incident were so real that the parents of the students involved in the suit kept them home from school two days later."

CNN first learned of the court's ruling on Twitter.

Interesting that the vast majority are still teenagers. It would actually be easier to get the younger ones in terms of schooling. The older ones present much more difficulty in schooling because we do not have time to school them (when they come older) and get them to our standards in order to graduate. Many of those will be drop outs and will not be the net contributors to our tax base that people think they will be. These are not people coming from the middle class of a war torn country (such as the Afghanis or Vietnamese who came here). This is a more difficult group in terms of schooling and they are coming at a time when we are trying to recover from a major recession. This is the problem. If the populace here had not just suffered economic setbacks (constant threats of sequestration and no wage gains), the overall climate may be different (more welcoming). As it stands, people wonder if their own children will be able to compete in the future economy. They don't have the feeling of assurance that they need in order to start paying for other people's children (yet). This stuff goes in cycles. It also doesn't help that some of the people who are so welcoming are the ones who have not suffered and/or have their kids in private schools. This area has been a bubble and it has been easier historically to accept immigrants, but these immigrants are different and these times are different. Fairfax County is definitely changing.

Just because the big changes in FCPS student numbers are pointed out doesn't mean someone is racist. It also doesn't mean an indictment of FCPS because they are stuck with the kids who show up so it's not their fault. It anything it's an indictment of the Feds because they aren't enforcing border control and of the Fairfax Board of Supervisors because they aren't doing anything about illegals in Fairfax County.
So yes it makes it worse in FCPS in the classrooms and in the budget.
It is even more offensive to people who have waited and paid to immigrate here legally.

Happy 4th of July! I hope all the parades, picnics, and fireworks will be terrific! There are so many places in the world today where the “rockets’ red glare and bombs bursting in air” actually are military armaments, not carefully planned colorful displays we enjoy at the Mall or local park. I am thankful every day that we live in such a great, and peaceful, nation. No wonder people want to come here.

And there’s the rub. Recent media reports have focused on thousands of children fleeing to the United States from Central and South America, unaccompanied by their parents or other responsible adults. The federal government, according to the reports, is housing the children in old federal facilities in Arizona, California, and Texas, while efforts to identify the children and what to do about them continue. The numbers apparently have overwhelmed the ability of the Border Patrol and other federal agencies to handle the situation. Last week, the small town of Lawrenceville, Virginia, near the North Carolina border, was in the news when it learned of a federal plan to house 500 children at St. Paul’s College, a historic black college that is closing. The town of about 1400 residents apparently had not been consulted ahead of time, and town leaders were concerned about how its existing infrastructure – police, fire protection, schools – could handle an increase of so many children at once. No one had time to plan.

And there’s another rub. Local governments provide local services; the feds don’t. Local governments plan for gradual growth in services needed by residents and businesses, based on trends tracked across time. While extra services, such as those generated by weather-related incidents, usually can be accommodated on an emergency basis for a short time, the situation is much different for long-term needs. Long-term planning is critical, and that is why, at Tuesday’s Board of Supervisors meeting, I asked County Executive Ed Long to examine the issues and provide the Board with recommendations about steps that may be needed to handle an unexpected influx of unaccompanied children, if such an event should occur, and report back at our July 29 Board meeting.

Fairfax County has a long history of welcoming newcomers. In the mid-1970s, Vietnamese refugees, many with professional degrees, came to Fairfax after the fall of Saigon. In the early 1980s, Afghani refugees, including educators and engineers, came after the Russians invaded their homeland. They have opened businesses, raised families, and became an integral part of the diverse tapestry of our community. In 2005, after Hurricanes Katrina and Rita devastated the Gulf Coast, Fairfax County welcomed a few hundred families who were forced out of their homes. Volunteers and non-profit agencies stepped forward, as did the school system, to provide temporary assistance for about a year, until the families could return home.

We should be able to meet any challenge, with good planning. That’s the gist of my Board Matter, and something to think about on Independence Day.

The largest increase in unaccompanied minors is coming from Central America. That's the group that both advocates and opponents want to highlight for their own reasons. As a sympathy play in the case of the former. To make it appear more of a crisis and failure of the administration on the part of the latter. They also have more media appeal as a story as well. So that's the group that gets played up on all sides. As the numbers show though, they represent a small percentage of the overall numbers with even most of the 'children' being male teenagers 14-17, and most of the younger kids travelling with adults.

The foreign-born percentage of the population hit bottom in 1970. It has been increasing ever since, just now staring to reach the 13-15% range that had been the accepted norm between the Civil War and WWI. The rate of increase in enrollment in FCPS between 2000 and today has in fact been at an annual rate of 1.1%. That's simply indisputable. FARMS are of course funded by the Feds, not Fairfax. We do pay extra for ESOL, just as we pay extra for athletes, the gifted and talented, IDEA kids, and various other populations. This is part of the package when you do universal free public education. Try moving someplace else if you don't like it.

So you can talk all you want about a 1.1% increase in the school population since 2000, but the most recent stats show an increase in ESOL at the rate of 9% per year for 2007-2012. Those kind of increases have hugely affected the recent budgets. When you add in the 2000-2006 numbers, you can dilute the percentage of increase. The fact is that the increases have been greater in the most recent years and continuing those kinds of increases is draining the system.

What is so hard to understand here? The student population at FCPS has increased since 2000 at an average rate of 1.1%. Simple and indisputable fact. ESOL students cost more than an average student. So do athletes, IDEA kids, G&T, and kids in alternative schools. These groups are all part of free universal public education. Free and reduced meals are meanwhile paid for by the feds, not FCPS. What's actually been draining the system has been the Great Recession that right-wing goobers produced, and the Board's reluctance to make up for those lost revenues by raising tax rates sufficiently to allow it to send a proper allotment to the schools.

In Australia, they don't even let them set foot in the country. They send them off to some camp in New Zealand while they are "processed". In Europe there is no automatic citizenship by birth. In Germany there are no "German as a Second Language" classes in the public schools. The immigrants must pay for their own German lessons until they can test high enough to go to public school. I know this because I had an Afghani student who had spent 6 years in Germany before coming here. Her German was excellent (yeah, German accent in English) and she actually missed Germany (spending your formative years somewhere is significant in terms of your idea of where you are from and who you are). We are truly a great country in terms of what we do for immigrants. We should be proud of that, but we should know our limits.

As for FCPS budget issues, there are many causes, chief among them being the Board of Supervisors' refusal to restore to FCPS not just the resources they lost during the Great recession, but even what was taken away from them at that time. Class sizes are growing, teachers are leaving, programs are being cut back. The strength of Fairfax County as a vibrant and successful economic area springs from the strengths of our school system. Deliberately gutting it is simply folly.

A student's being Hispanic doesn't cost FCPS anything extra, and there are many well-off Hispanic families in the county whose children need no more special services than yours do.

Sure more people live here, but more dwellings are NOT built each year. My own street has more and more cars as each house is occupied by more and more people. And people do not receive some sort of wage increases in an average year. If you hadn't noticed, sequestration is still in effect and many workers were furloughed last year. People actually made LESS money. Many of FCPS's own employees have had their contracts reduced. The federal government is a big driver of the local economy. Will Congress ensure that job cuts will not happen and we will continue to be the rich county we have been? It certainly doesn't look too good for the next couple of years. But, yes, long term we may have growth if the private sector grows. But those personal care jobs for baby boomers are not the kind of jobs that will create a lot of taxes. Many of the boomers will move out of this area in order to find cheaper overall costs (and less traffic and better lifestyle). I suppose fast food and cheap construction labor (the roads really need to be fixed) will always be needed. I wonder if there is enough competition in those areas. The lower the wages go, the more people you will have in each house, apartment, etc. This type of housing is not always the most sanitary or sane (more cars, more neighborhood strife, more urban social problems). As Mr. Moon said, you have a tipping point in schools that become 40% or more FRMs. I'm not making this stuff up.

Capitalism is great, but we also have finite resources on this planet. The challenge going forward will be to balance our resources with our growth. So far (based on the huge debt in this country), we haven't been doing a very good job.

Just 21% of Fairfax County residents are employed by ANY level of government, but if you want more economic support from Congress, you'll have to get rid of the Republicans. Private sector wages have also been growing and are expect to continue to do so.

Strong long-term growth in demand for home, health, and personal care services will bring more immigration. CEO's will continue to make more than these new arrivals do. They will all still pay the same taxes that you do. If those are not enough, maybe we should enact a meals tax to help out.

Now we need to get ourselves caught back up, but neither the Board nor the state is addressing that need at all, much less sufficiently. A meals tax dedicated to FCPS would be one idea, and simply getting independent taxing authority to FCPS would be another. The course we are on will fly us straight into a mountain. Some sort of correction is imperative.

How is it that practically every other school area (including the oh so awful PWC) did not suffer so much so they can pay more to their teachers? They must be making a lot more in tax revenue? Their citizens are willing to pay more in taxes?

Throw your little Stewie fit on-line. The numbers from FCPS tell us all we need, that ESOL percentages are skyrocketing and free & reduced numbers are too.

We can see neighborhood houses with lots and lots of people living in them. Many families don't live in one house breaking housing laws when they are legal.

The money in FCPS keeps getting directed to kids who are increasing strain on the system needing more and more services along with their parents.

Retired and wealthy? Write a big fat check to the county to enforce immigration laws and save us from becoming Detroit then.
