Ticketed for Texting BUT I WASN'T TEXTING!!!

So I have today off but promised my manager that I would listen in on a network maintenance call this morning that started at 6am. I went to get some gas for my truck and I had my cell phone on and sitting on a cell phone holder (see picture below).

I hit a dead zone on the way to the gas station and lost the call I was on. I was aware of the new laws, and decided to pull off to the side of the road and redial into the conference bridge and rejoin my call. To do this, I had to take the phone out of the holder. (It's a conference call so I couldn't just press "redial" on my phone, because you have to enter the Passcode to join the conference bridge). After I had rejoined my call, I put the phone back in the holder, THEN GOT BACK ON THE ROAD. I was pulled over by the cop within 10 seconds of getting back on the road.

The cop gave me a ticket and told me that because I was in my car, with the engine running, and using my phone, that's why I got the ticket. When I explained that I had pulled off the road to get back on my call, he simply told me that there was nothing he could do for me and gave me the usual bullshit about paying online, court dates, etc. When I got home I read the ticket closer and showed that he had issued the ticket for "Texting while driving." This was over in Fairfax right near Fairfax circle.

PS: When I listen to the conference calls in my truck, I have it on speakerphone and don't hold it in my hand. This whole thing is so ridiculous!

You shouldn't be listening to calls in your vehicle (hands-free or not). It endangers everyone around you because its divided attention!!!!!!!!

You know what's ridiculous. Driving around in an oversized gas guzzlers to compensate for the facts that your a fatty, loser, and if your male that you have a teenie weenie.

Good for the cop, he got you fair and square. Next time he should also write you a ticket for being a loser and sissy cry baby.

Listening to your phone is not against the law.

Even if he was texting, my understanding of the law is that it only applies if your car is moving.

Personally, I think the new texting law is silly. We already have reckless laws and laws about paying full attention. Why make a specific law about texting? What about playing a game on an iPad while driving, reading a book, or tying my shoe?

I even pulled off the road and I was never texting, just redialling into my conference call from my cell phone (on the side of the road).

Not to mention your a lier. The fact that you have to even mention going to the gym is proof that your a fatty in denial. So if your gonna lie in your head about that, I'm sure your slandering the police who did a good thing by pulling you over.

This story is such BS. I love the effort of OP to go this far though to create a situation right on the fringe of a defense for the brand new law to try to get us riled up. OP likely doesn't own a truck, let alone hold a job that requires a weekly password protected conference call.

LOL The "truck" Is probably some 15-20 year old beat up Broncho or other crap SUV that barely runs. There conference call is probably them calling their boss at McDonalds/Walmart or their parole officer/welfare office/baby momma.

Dear Fairfax County Police,

Please continue to pull over this lying crybaby. Not only are your protecting our safety from this lunatic by preventing him from killing someone, you are also providing us with entertaining stories on Fairfax Underground. You could also help him to lose weight by forcing him to get enough points where he would loose his license and have to walk to the gym so that he would get an actual workout instead of him hogging all the machines at the gym by sitting on them for 10 minutes before he does 5 reps on some pathetically low weight setting.

I'm very happy and you did a great job pulling him over this morning! Please continue to pull him over whether it's texting, speeding, disobeying cross walks, running through red lights or reckless driving. In fact I would really love to see him get a reckless driving ticket.

Get the following items:

Your phone records from your bill
The log of the calls from your phone showing two calls at that time
A picture of the spot where you were pulled over

Your phone bill will show that there were no texts during the time frame in question, it will also support your argument about the conference call & the picture of the spot where you were pulled over will coincide with your story & where you were eventually pulled over.

Go to your court date, present the info to the prosecutor and get the case thrown out. Maybe make a bit of a stink about having to waste a day of vacation for this BS.

Matter of fact, if I were you, I would insist on a trial, present the info to the judge and make a big stink about having to take time off of work etc to deal with an inept cop and a ticket quota.

We will eventually have this law removed when everyone takes their case to court and proves each time that they were not texting, but making a phone call or checking their calendar instead. This law is ridiculous; as many have already said we have laws on the book for distracted driving.

I don't condone texting and driving (actually put it as dangerous as DUI) but I can't stand to see peoples rights getting trampled on and becoming victim's of the law.

Stay strong everyone. We will need the support for the upcoming legal battles.

I'm a contractor, so the day I go to court I will not be paid, unless I go into work earlier and stay late. Oh and I intend to make a big fuss over it.

Yeah, hopefully it will be replaced with a ban on ANY talking on or fucking around with your phone while driving instead of paying attention to your driving like you should be.

Well, if you take a look at the logo in the center of the steering wheel (which is only partially visible), as well as the logo in the center of the tachometer, this is the dashbaord of a BMW. Last I checked, BMW didn't have too many trucks here in Fairfax County!

Here is the code from the State Law...

§ 46.2-1078.1. Use of handheld personal communications devices in certain motor vehicles; exceptions; penalty.

A. It is unlawful for any person to operate a moving motor vehicle on the highways in the Commonwealth while using any handheld personal communications device to:

1. Manually enter multiple letters or text in the device as a means of communicating with another person; or

2. Read any email or text message transmitted to the device or stored within the device, provided that this prohibition shall not apply to any name or number stored within the device nor to any caller identification information.

B. The provisions of this section shall not apply to:

1. The operator of any emergency vehicle while he is engaged in the performance of his official duties;

2. An operator who is lawfully parked or stopped;

3. The use of factory-installed or aftermarket global positioning systems (GPS) or wireless communications devices used to transmit or receive data as part of a digital dispatch system; or

4. Any person using a handheld personal communications device to report an emergency.

C. A violation of this section is a traffic infraction punishable, for a first offense, by a fine of $125 and, for a second or subsequent offense, by a fine of $250.

For the purposes of this section, "emergency vehicle" means:

1. Any law-enforcement vehicle operated by or under the direction of a federal, state, or local law-enforcement officer;

2. Any regional detention center vehicle operated by or under the direction of a correctional officer responding to an emergency call or operating in an emergency situation;

3. Any vehicle used to fight fire, including publicly owned state forest warden vehicles, when traveling in response to a fire alarm or emergency call;

4. Any ambulance, rescue, or life-saving vehicle designed or used for the principal purpose of supplying resuscitation or emergency relief where human life is endangered;

5. Any Department of Emergency Management vehicle or Office of Emergency Medical Services vehicle, when responding to an emergency call or operating in an emergency situation;

6. Any Department of Corrections vehicle designated by the Director of the Department of Corrections, when (i) responding to an emergency call at a correctional facility, (ii) participating in a drug-related investigation, (iii) pursuing escapees from a correctional facility, or (iv) responding to a request for assistance from a law-enforcement officer; and

7. Any vehicle authorized to be equipped with alternating, blinking, or flashing red or red and white secondary warning lights pursuant to § 46.2-1029.2.

You can get a ticket for texting but they don't give out tickets for smoking or eating while driving. I have found those distracted drivers to be just as dangerous. Why not ban all activity while you are driving?

I wanted to give everyone an update. I went to court on this and they threw it out. It is not illegal to be pulled off on the side of the road (out of traffic) and doing stuff with your phone.

This law is full of holes. For example, dialing a number isn't 'texting'

Manually enter multiple letters or text in the device as a means of communicating with another person; or

That says nothing about numbers. Just text and just letters. A letter is not a number.

It also doesn't cover texting by using voice recognition.

§ 46.2-1078.1. Use of handheld personal communications devices in certain motor vehicles; exceptions; penalty.

A. It is unlawful for any person to operate a moving motor vehicle on the highways in the Commonwealth while using any handheld personal communications device to:

1. Manually enter multiple letters or text in the device as a means of communicating with another person; or

2. Read any email or text message transmitted to the device or stored within the device, provided that this prohibition shall not apply to any name or number stored within the device nor to any caller identification information.

B. The provisions of this section shall not apply to:

1. The operator of any emergency vehicle while he is engaged in the performance of his official duties;

2. An operator who is lawfully parked or stopped;

3. The use of factory-installed or aftermarket global positioning systems (GPS) or wireless communications devices used to transmit or receive data as part of a digital dispatch system; or

4. Any person using a handheld personal communications device to report an emergency.

C. A violation of this section is a traffic infraction punishable, for a first offense, by a fine of $125 and, for a second or subsequent offense, by a fine of $250.

For the purposes of this section, "emergency vehicle" means:

1. Any law-enforcement vehicle operated by or under the direction of a federal, state, or local law-enforcement officer;

2. Any regional detention center vehicle operated by or under the direction of a correctional officer responding to an emergency call or operating in an emergency situation;

3. Any vehicle used to fight fire, including publicly owned state forest warden vehicles, when traveling in response to a fire alarm or emergency call;

4. Any ambulance, rescue, or life-saving vehicle designed or used for the principal purpose of supplying resuscitation or emergency relief where human life is endangered;

5. Any Department of Emergency Management vehicle or Office of Emergency Medical Services vehicle, when responding to an emergency call or operating in an emergency situation;

6. Any Department of Corrections vehicle designated by the Director of the Department of Corrections, when (i) responding to an emergency call at a correctional facility, (ii) participating in a drug-related investigation, (iii) pursuing escapees from a correctional facility, or (iv) responding to a request for assistance from a law-enforcement officer; and

7. Any vehicle authorized to be equipped with alternating, blinking, or flashing red or red and white secondary warning lights pursuant to § 46.2-1029.2.
